Estoppel



Estoppel may be used in removal proceedings. However, estoppels is not a statutory form of relief from removal. Rather, estoppel is, effectively, an argument about fundamental fairness and equity. For example, if a person fails to meet the continuous physical presence requirement because of governmental misconduct, then a court may still use its equitable powers to find that the non-citizen meets the requirement.
